Professor Xie Libin from the College published an article, the Court's Interpretation of the Constitutionality of the Law-the Hope of the Implementation of the Chinese Constitution (Verfassungskonforme Gesetzesauslegung durch Gerichte—Hoffnungsschimmer für die Verfassungsverwirklichung in China), on the German law journal Yearbook of Contemporary Public Law (Jahrbuch des öffentlichen Rechts der Gegenwart,JöR) lately in its 71 volume of 2023.
This paper clarified the concept of constitutional interpretation, inspected how the Chinese academic community gradually pays attention to this system, sorted out the practice of constitutional interpretation of laws by the courts of the country, discussed the rationality of constitutional interpretation, and evaluated the potential of constitutional interpretation in promoting the implementation of China's constitution.
The Journal was first published in 1907 and was discontinued in 1939 during the outbreak of World War II. It has been republished since 1951 and is published annually exclusively by Maurs Seibeck press. It has an international outlook, following the academic tradition of Georg Jellinek and Gerhard Leibholz, the leading German public jurists. A large number of influential academic papers have been published in the past hundred years and it enjoys a sound reputation in German public law community.
In recent years, a large number of internationally renowned academics, including former judge of the German Federal Constitutional Court Brun-Otto Bryde, Austrian constitutional judge Michael Holoubek, former president of Austria Heinz Fischer, former president of the German Federal Constitutional Court Andreas Voßkuhle and former vice-president of the European Court of Human Rights Angelika Nussberger have published academic papers in the Journal, which had a profound impact on the German and international law community.
Xie's work in the Journal has helped the College to tell a good Chinese story on the international arena, raising the University’s international profile and promoting academic exchanges between China and the rest of the world.
