The Annual Meeting of Beijing Comparative Law Society of 2023 & Symposium on the Chinese-Style Modernisation of Rule of Law and the Development of Capital's Foreign-Related Rule of Law was held in Xiangshan Conference Centre in Beijing on the afternoon of 28 Oct, 2023.
The event was hosted by the Beijing Comparative Law Society, and co-organised by the College, Beijing Zhongce Law Firm and Beijing Fayi Technology Company. Over 100 experts and scholars from universities, research institutions, law firms and enterprises in Beijing had an in-depth discussion and exchange on the macroscopic and concrete problems of foreign-related rule of law and Chinese-style modernisation of rule of law.
Liu Chaomao, Second-Level Inspector of Beijing Law Society, and Chang Baoguo, Vice President of the University, presented opening remarks respectively. Dean of the College & President of the Beijing Comparative Law Society Xie Zhiyong made a report on the annual work of the Society at the meeting.
In his speech, Liu Chaomao said that upholding the rule of law at home and the rule of law in relation to foreign affairs in an integrated manner is an important strategic plan for the overall development of China's national cause and an urgent task for the comprehensive rule of law. In his opinion, the theme of this year's conference has high research value and practical significance. He hoped that Beijing Comparative Law Society would play a leading role and serve the overall needs, and that the members would closely focus on the practice of ruling the country by law in an all-round way in the new era, earnestly strengthen the study of comparative law theory and practice, which is rooted in Chinese culture, based on China's national conditions, solves China's problems while not be western theory 'porter', and offer suggestions for the construction of China's independent legal knowledge system..
Chang Baoguo's speech was read out by a representative. He expressed that in recent years the establishment of the rule of law concerning foreign affairs in the country has been developing continuously, as its practice has been progressing step by step and its study has made great progress. In his words, the research field expanded, the research question deepened, the research content unceasingly updated along with the practice development and its systematisation has played an important role in promoting the country's opening-up, participating in global governance and safeguarding national security and interests. He said that the University would continue to explore more diversified forms of cooperation with the Society, law institutions, judicial practice departments and enterprises, and that continue to strengthen, broaden and deepen its cooperation with a view to deepening research and training in foreign-related rule of law and contributing to the great practice of fully advancing the rule of law and Chinese-style modernisation.
Xie Zhiyong gave a brief summary of his work over the past year. The Society successfully completed the civil affairs registration procedure of an independent legal person and obtained the Certificate of Registration of a Legal Person. In terms of improving its organisational structure, it established an internal management organisation, drafted and approved the rules and regulations of the Society, including the financial system. It participated in various training courses organised by the Beijing Law Society and the training of new associations organised by the Beijing Municipal Bureau of Civil Affairs, and started to run the Society's WeChat Official Accounts. Xie stressed that this year the Society would carry out substantive work and achieve outstanding results on two fronts. First, the formation of three academic subcommittees, namely, the Academic Committee on Data Law and Personal Information Protection Law, the Academic Committee on Insolvency Reorganisation and the Academic Committee on Regional Law and Laws of Different Countries. Second, the Society would hire 11 academic advisors, including Mr. Jiang Ping, to form an academic advisory committee to provide strategic guidance for the development of the Society.
During the symposium, focusing on the theme Chinese-Style Modernisation of the Rule of Law and the Development of the Capital's Foreign-Related Rule of Law, Prof. Zhang Qi from Peking University Law School, Prof. Liu Wenjie from the College, Associate Dean of Law School of Beijing University of Aeronautics and Astronautics Pan Weijiang and Senior Consultant of Beijing Zhuowei Law Firm Yang Bing delivered keynote speeches respectively. The topic of Liu Wenjie's speech was the Construction of Data Rights from the Perspective of Comparative Law.
There were four sessions of the conference, the Data Law and Personal Information Protection Law, the Region Law and Laws of Different Countries, the Bankruptcy and Reorganization and Dialogue between Comparative Public Law and Comparative Private Law. A/Prof. Sun Haibo from the College introduced his research on the application of judicial precedents under the statutory law system. A/Prof. He Qihao from the College presented his report on the Private Governance of Public Health Events -- Insurance Governance and Its Limits. Lecturer Jiang Feng'an from the College analysed the problem of data compliance protection with the topic of Comparative Study on Facilitation Measures of Data Cross-Border Flow. PhD candidate from the college Xiao Yi presented a report entitled the Comparative Law with Chinese Characteristics -- from Discipline System to Knowledge System.
At the closing ceremony, Vice President of the Society A/Prof. Lu Nan from the Tsinghua University School of Law, Prof. Bo Yanna from the College, He Qihao, and A/Prof. Zhang Long from the Beijing Technology and Business University gave a summary of each session respectively. Xie Zhiyong made concluding remarks.
Vice President of the Society & Associate Dean of the College A/Prof. Liu Chengwei and Lecturer Xu Jianbo from the College also attended the meeting. Sun Haibo was elected as the Chairman of the Academic Committee of Data Law and Personal Information Protection Law during the meeting.
On the morning of the day, the Society held its first council meeting. This council and annual meeting were the first of the Society after it was reorganised as an independent legal person social organisation. It is believed that under the leadership of the Beijing Law Society and the joint efforts of the members, the Society would make greater contributions to the development of the capital's foreign-related rule of law.
