The Research Centre for Ascertainment of Foreign Law of the China University of Political Science and Law (CUPL) is the base for the ascertaining of foreign law of the Fourth Civil Division of the Supreme People's Court of the People's Republic of China (Civil Division No.4), co-established by CUPL and Civil Division No.4. It was opened by then the Deputy President of the Supreme People's Court Justice HE Rong and then President of CUPL Professor HUANG Jin.
Taking advantage of personnel and resources from the College of Comparative Law in foreign law and that from the School of International Law of CUPL in international law, as well as drawing and combining sources from international private law, foreign legal system and trial theory research in China and abroad, the Centre aims to become a think tank for the Supreme People's Court in foreign-related civil and commercial trials, a hub of foreign legal information and materials and a pace-setter in foreign law research.
The Centre makes the most of the superiorities of Supreme People's Court and that of CUPL in legal practice and academic research, benefits from the community of jurisprudential scholars and legal profession in China and abroad, strives for 1) building up a service hub of foreign law literature, materials and information; 2) accepting commissions from the Supreme People's Court and people's court at all levels and providing them with consulting service on issues on the application of law in foreign-related civil and commercial trials, particularly in the ascertaining of foreign law; 3) hosting judicial trainings to enhance the competence in foreign law ascertaining for front-line judges focusing on foreign-related civil and commercial trials in China; and 4) co-organising the foreign law ascertaining high-end forums to improve foreign-related civil and commercial trial theory.
The Centre is not only a research institution of foreign law ascertaining, but also a consulting service agency of the ascertaining as well as a think tank specifically facing the judicial and legal practice community.
The Centre initially officially appointed twenty experts in foreign law ascertaining from the Peking University, Tsinghua University, Renmin University of China, Wuhan University, University of International Business and Economics, University of Macau and CUPL with systematic legal training background and doctorate degrees in law from foreign countries. They are proficient in a certain law, familiar with relevant foreign legal system and of high academic standard.
The Director of the Centre is Prof. GAO Xiang. The Executive Director is A/Prof. SUN Haibo.
