CCL co-holds Symposium on Subject Construction of Health Law and Establishment of Independent Knowledge System

The College, the and the Health Law Research Centre of CUPL co-hosted the Symposium on Subject Construction of Health Law and Establishment of Independent Knowledge System on Xueyuanlu Campus on 5 Nov, 2023.



Twenty-five health law scholars from Tsinghua University, Peking University, Renmin University of China, Chinese Academy of Medical Sciences, Nankai University, Chinese Academy of Social Sciences, Guangdong University of Foreign Studies, East China University of Political Science and Law, Capital University of Medical Sciences, Beijing University of Chinese Medicine and CUPL, in total over 10 institutions, exchanged their views online and on-site simultaneously and had an in-depth communication and discussion focusing on theme of this conference.



Dean of the College Prof. Xie Zhiyong moderated the opening ceremony. Vice President of the University Prof. Shi Jianzhong and Dean of the School of Law Prof. Jiao Hongchang presented remarks.



The first session Health Law Discipline Construction and Development was presided over by Prof. Wang Qingbin, Deputy Director of Scientific Research Department of the University. Executive Vice-President of the Chinese Health Law Society Prof. Wang Chenguang from the Tsinghua University Law School delivered a keynote speech.



Wang Chenguang explained the nature of health law. According to him, on the one hand, the basic concept of health law has constantly become clearer than before. He pointed out that the Law on Basic Medical Care and Health Promotion put forward "medical care" and "health promotion" as two parallel concepts, so that ‘health’ is no longer limited to the ‘medical’ field. On the other hand, the development of health law still has the problem of double marginalization. On the issue of the health and Health Law System, Wang said that basic health system should be established to cover both urban and rural residents with a focus on people's health and that more detail should be put on the public health service system, the healthcare system, the health financing insurance system and the medication guarantee system.


The second session Establishment of Independent Knowledge System of Health Law was presided over by Dean of the Medical Humanities School of Peking University Prof. Wang Yue. Vice-President of the China Health Law Society & Dean of the Guangdong University of Foreign Studies School of Law Prof. Chen Yunliang gave a keynote speech.



Wang agreed with the previous session's emphasis on interdisciplinary integration and cooperation. He believed that the bottleneck of the development of health law lies in the problem of talent cultivation, so it is necessary to train high-quality doctoral students of health law to better grasp the right to speak in the academic community. Anonymous review of paper could be considered in the cross-disciplinary and new areas of law.



Chen said that leading law universities such as the China University of Political Science and Law University organising high-end forums such as the Health Law Forum has a huge impact on health law research, and that it is hoped that senior law schools and departments would actively take the lead in carrying out health law research. He constructed the independent knowledge system of health law from six aspects, the basic concept, the basic constitution of health law, the basic right system, the unique procedure system, the rule of law concerning foreign affairs, and the sinicisation of health law.
